12: A Short Guide to…. the Misuse of Drugs Act 1971

A short guide to the main piece of drug control legislation in the UK, describing its history, how it works and arguments for its reform or repeal. Draws on my research on the historical origins of the Act (here and here) and its legal structure and functioning (here).

  1. Beautifully written and hugely informative exposition of one of the most mythologised pieces of UK drugs law.

    Thankyou. An interesting and detailed look at the origins of the Act and how the debates leading up to its implementation were more nuanced than some may imagine.
    However, whatever the intention of the originators of the Act, it is hard to argue with the fact that it has been implemented in a way that has increased harm and singularly failed on its promise to prevent the misuse of dangerous and harmful drugs.

      I agree. My point is 1) that’s about poor policy and 2) much better policy is possible within the framework of the MDA. None of that means, though, that starting afresh with a new statute wouldn’t be the best course to take.
